French court backs upward-only lease indexation
A French court has backed lease indexation clauses that only allow for the application of rent increases, and not rent reductions. The Douai appeal court ruled the parties to a commercial lease are entitled to agree a clause that rent will only be adjusted upwards when the rent is reviewed to take account of movements in a reference index.
